How it works
The Orchard offers worldwide digital and physical distribution for your music through two unique distribution options.
I. Worldwide Digital Distribution.
II. Digital & Physical Global Distribution.
Here's how they work:

TO ACTIVATE YOUR ACCOUNT: Send The Orchard 5 CDs and $49 per release.
- This is a one-time payment -- there are no additional renewal fees
required to keep your release distributed through The Orchard.
- When you add five or more releases to The Orchard at the same time, registration costs $30 per release [$19 discount per release]. If you'd like to take advantage of this discount, you must download and complete a special PDF form at the beginning of our online “add release” form
YOU'LL RECEIVE:
- Worldwide Digital Distribution. Your songs will be made
available on a track-by-track basis to millions of Digital
Music Service [DMS] subscribers. Please note: Our DMS
partners will offer your music for sale approximately six weeks after we've
received your music. Click
here to find out exactly what happens after we've received your music.
- 70% of all revenues generated from your music. Our DMS
partners pay The Orchard for all Orchard-affiliated music sold. From that
gross revenue, you will receive 70% of all revenues generated from your music,
minus any costs associated
with the sale.
- Discounts on registering additional releases with The Orchard.
Once you add your music to The Orchard, you can register additional releases
for a discount. For Worldwide Digital Distribution, you can
register additional releases for $35 each [$14 discount].
For Digital & Physical Global Distribution, you can register
additional releases for $69 each [$30 discount]. To take
advantage of this offer, visit our Artist
& Label Login section once your music is registered.
- Exposure and more. Here's how we will use the 5 CDs:
- We will use one copy to encode your songs for use on the DMSs.
- We will send one copy to All
Music Guide. The All Music Guide is the world’s most comprehensive
online database of CD releases.
- We will send one copy to Muze. Muze
supplies album artwork, soundclips and release information to various
Internet music stores.
- We will submit one copy to our in-house A&R team. The Orchard is
widely recognized in the music industry as a vast source for emerging
talent. One of The Orchard's most recent and visible success stories is
the discovery and development of the Raveonettes, a band The Orchard began
working with in 2002 and then guided through a high-profile deal with
Columbia Records.
- One CD will be filed as a backup copy for our office.
PAYMENT DETAILS
- The Orchard pays artists and labels quarterly in US dollars for all music sold.

CDs:

- The remaining 25 CDs will be used to fulfill orders. The Orchard will
assign each release a unique bar code and make each release available
for SoundScan, the company that tracks sales to determine the Billboard
sales charts.
PAYMENT DETAILS:
- For all third-party CD retail sales, The Orchard accepts all music on a consignment basis and pays the artist on a net income basis. The artist will receive payment one quarter after The Orchard receives payment from its partners, which is often 3-6 months after the sale occurs. Some physical distributors (Baker and Taylor, Amazon for example) order music on a consignment basis, so music shipped does not always equal music sold. Once a distributor sells the music, they pay The Orchard, and we pay the artist.
- For all physical and third-party online retail sales, The Orchard withholds 25% of the artist's earnings as a reserve because some product may be returned and charged against The Orchard's account. If The Orchard ships more than 100 units in any given quarter, The Orchard reserves the right to extend the reserve amount. After two quarters, this reserve is liquidated and paid to the artist.
- Accounting is separated into two areas: digital track sales and
third-party CD sales.
- Artists: Payment for your sales will be processed quarterly
when your release balance for third-party CD sales reaches
$250 or when your release balance for digital track sales
reaches $10. If your third-party CD sales balance for a specific release
is less than $250, or if your digital track sales balance
for a specific release is less than $10, payment will be carried over
until either balance reaches its minimum requirement.
- Labels: A Label is defined as any artist or label that
submits five or more releases to The Orchard at one time. Payment for
your sales will be processed quarterly when your account balance for third-party
CD sales reaches $1000 or when your account
balance for digital track sales reaches $50. If your
aggregate third-party CD sales balance is less than $1000, or
if your aggregate digital track sales balance is less than $50, payment
will be carried over until either account balance reaches its minimum
requirement.
PRODUCT MANAGEMENT
If some of your music is sold at retail, the retailer may wish to buy and stock more of your CDs. When this occurs, we will send you an email re-order request for more music, and we ask that you fulfill each order in a timely manner (two weeks or less) so that retailers do not cancel their orders. You can keep track of your shipments online in My Account.
